ASSEMBLY AMENDMENT 84, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2009 ASSEMBLY BILL 75

AB75-ASA1-AA84,1,1 At the locations indicated, amend the substitute amendment as follows:

AB75-ASA1-AA84,1,5 1. Page 169, line 2: increase the dollar amount for fiscal year 2009-10 by $16,830,400 and increase the dollar amount for fiscal year 2010-11 by $15,829,100 for the purpose of increasing funding for the purposes for which the appropriation is made.

AB75-ASA1-AA84,1,9 2. Page 172, line 3: decrease the dollar amount for fiscal year 2009-10 by $23,223,800 and decrease the dollar amount for fiscal year 2010-11 by $16,753,200 for the purpose of decreasing funding for the purposes for which the appropriation is made.

AB75-ASA1-AA84,1,10 3. Page 650, line 13: delete lines 13 to 16 and substitute:

AB75-ASA1-AA84,1,12 " Section 1417g. 50.14 (2) (intro.) and (bm) of the statutes are consolidated, renumbered 50.14 (2) (bm) and amended to read:

AB75-ASA1-AA84,2,9 50.14 (2) (bm) For the privilege of doing business in this state, there is imposed on all licensed beds of a facility an intermediate care facility for persons with mental retardation an assessment in the following amount per calendar month per licensed bed of the facility: (bm) For intermediate care facilities for persons with mental retardation, an that is equal to the amount calculated by multiplying the projected annual gross revenues of all intermediate care facilities for persons with mental retardation in this state by 0.055, dividing the product by the number of licensed beds of intermediate care facilities for persons with mental retardation in this state and dividing the quotient by 12.

AB75-ASA1-AA84, s. 1417g Section 1417g. 50.14 (2) (am) of the statutes is amended to read:

AB75-ASA1-AA84,2,15 50.14 (2) (am) For nursing homes, an amount the privilege of doing business in this state, there is imposed on all occupied, licensed beds of a nursing home an assessment per calendar month per occupied, licensed bed that may not to exceed $75 $100.70 in state fiscal year 2009-10, and that, beginning in state fiscal year 2010-11, may not exceed $139.20.

AB75-ASA1-AA84, s. 1417h Section 1417h. 50.14 (3) of the statutes is amended to read:

AB75-ASA1-AA84,2,23 50.14 (3) By the end of each month, each facility shall submit to the department the amount due under sub. (2) for each licensed bed of the facility that is subject to assessment for the month preceding the month during which the payment is being submitted. The department shall verify the number of beds licensed subject to assessment and, if necessary, make adjustments to the payment, notify the facility of changes in the payment owing and send the facility an invoice for the additional amount due or send the facility a refund.".

AB75-ASA1-AA84,2,24 4. Page 1734, line 11: delete "$337,361,800" and substitute "$363,512,900".

AB75-ASA1-AA84,2,25 5. Page 1815, line 6: after that line insert:

AB75-ASA1-AA84,3,5 "(11f) Medical assistance nursing home rate increase. The department of health services shall increase reimbursement rates paid to nursing homes under the Medical Assistance Program under subchapter IV of chapter 49 by at least 3 percent in each fiscal year of the fiscal biennium in which this subsection takes effect.".
